Ellen Weintraub, the chair of the US Federal Election Commission (FEC), called out Donald Trump's attempt to remove her from office as illegal. After receiving a letter from the president claiming her removal, Weintraub, a staunch Democrat, clarified that the president had not followed the proper legal procedure for firing a commissioner, standing firm in her role while criticizing the president’s actions.
Ellen Weintraub, the chair of the Federal Election Commission (FEC), rejected President Donald Trump’s attempt to remove her from her position, labeling it as illegal. On Thursday, she posted a letter dated January 31, 2025, signed by Trump, which stated, "You are hereby removed as a member of the Federal Election Commission, effective immediately." Weintraub swiftly responded, explaining that there is a clear, legal procedure for removing FEC commissioners — one that was not followed in this case.

In a bold post on X (formerly Twitter), Weintraub wrote, “There’s a legal way to replace FEC commissioners – this isn’t it.” She added, "I’ve been lucky to serve the American people and stir up some good trouble along the way. That’s not changing any time soon."

This conflict comes as part of Trump’s larger effort to reshape the federal government by replacing civil servants with more loyal officials. This overhaul is a major part of his strategy to streamline the bureaucracy, but the attempt to remove Weintraub has raised concerns over the legality and motives behind such actions.

Weintraub, who has served on the FEC since 2002, is known for her strong advocacy of campaign finance law enforcement and transparency. As chair, she has pushed for stricter regulations in light of rising concerns about the influence of money in politics. Her leadership has made her a key figure in debates over campaign finance reform, and her dismissal would significantly impact the commission’s ability to uphold election laws.

The Federal Election Commission has six commissioners, with three from each major political party. The commission operates on the principle that at least four votes are required for any official action, ensuring bipartisan oversight. This balance has allowed the FEC to serve as a crucial body in regulating political spending and ensuring the integrity of US elections.

Trump’s letter also arrives amid ongoing partisan tensions surrounding the FEC’s role in enforcing campaign finance laws. While Republicans, including Vice-Chair James Trainor, have long criticized the commission’s practices, Weintraub’s removal would likely further deepen these divisions. If her dismissal proceeds without following proper procedures, it could raise concerns about the independence of the FEC and the potential for political influence over its decisions.

Weintraub’s firm stance against Trump’s actions highlights the importance of legal processes in ensuring the impartiality of federal agencies. Her position remains secure as long as the law is upheld, and she has received support from those in favor of maintaining the integrity of the FEC. The unfolding legal and political battle over her removal is likely to have lasting implications for the future of the Federal Election Commission and its role in overseeing US elections.
